I think the main thing is you need to retain the cat & whatever other smog equipment originally came with the engine. The general rule for engine swaps in CA is the engine can't be older than the vehicle you're swapping it into. For a TJ, depdending on the year, you'd have to do a '97-'06 model-year engine.
